Kalshi and Coinbase Obtain Partial Injunction in Illinois as Another Court Disagrees
A federal judge in Illinois granted Kalshi, Coinbase, and the CFTC a partial injunction in a sports event contracts case, while another court ruled otherwise.

A federal judge in the District Court for the Northern District of Illinois granted preliminary partial injunctions in favor of Kalshi, Coinbase, and the Commodity Futures Trading Commission, as reported by the specialized platform The Defiant. The decision favors platforms that allow trading on the outcomes of sports events, in opposition to state-imposed licensing rules on this activity.
The judge concluded that Illinois's licensing rules for sports event contracts likely conflict with federal derivatives law, while deferring the transaction fees issue to a later stage and requesting the parties to submit proposals for the wording of the order. This means the impact of the decision remains partial and temporary until the final text is drafted.
In a separate track, the Sixth Circuit Federal Court of Appeals ruled that the Commodity Exchange Act does not preempt gambling laws in Ohio and Tennessee, vacating an injunction previously issued in Tennessee. This ruling moves in the opposite direction of the Illinois decision, even though both cases involve roughly the same legal question.
The divergence between the two courts points to the possibility of the matter reaching the Supreme Court to settle the issue of federal regulator jurisdiction versus state laws in regulating event contracts. Final rulings have not yet been issued in either case, and the exact language of the partial order in Illinois is expected to become clear after the parties submit their proposals in upcoming hearings.
