US Judge P. Kevin Castel rejected the challenge filed by Alphabet, Google's parent company, against publishers' estimates of damages in the AdX digital ad platform case, paving the way for a jury trial in the federal court in the Southern District of New York. The decision means publishers will be able to present their claims to a jury rather than having them decided without a trial.
The value of the claims exceeds $3.2 billion, including about $1.7 billion for a class of around five thousand publishers, about $900 million for USA Today, and about $600 million for the Daily Mail, according to damages calculations submitted by publishers in the lawsuit.
The judge has not yet set a start date for the trial, and Google said it will defend against the remaining claims, noting that allegations brought by publishers using another ad-buying tool were dismissed from the case. The absence of a trial date leaves the timeline open to hearings that could span months before any ruling is issued in the lawsuit.
The case revolves around AdX, a Google ad platform that enables publishers to sell their ad space to advertisers via an online auction, and the claims pertain to the platform's practices in this market. Investors in tech and media stocks are closely watching the progress of the lawsuit, as any ruling could obligate the company to pay billions of dollars and reshape how digital ad revenues are shared between platforms and publishers.
