Saudi Arabia Escalates Enforcement of Personal Data Protection Law as International Transfer Risks Rise

The authority responsible for personal data protection in the Kingdom of Saudi Arabia (Saudi Data and Artificial Intelligence Authority) is escalating its regulatory enforcement of the Personal Data Protection Law (PDPL), while tightening restrictions related to transferring data outside the Kingdom, a development causing concern among broad segments of multinational corporations.

The law generally requires obtaining prior consent or satisfying specific criteria before transferring the personal data of Saudi citizens to servers or entities outside the Kingdom, which is complicating operations for companies reliant on cloud infrastructure or external data centers.

Companies seeking compliance must document a legal basis for every international data transfer and adopt adequate contractual safeguards with recipient parties abroad, in addition to conducting periodic assessments of the transfers' impact on individual privacy.

Indicators suggest that the early symbolic implementation phase has ended, and the authority is now more prepared to actively exercise its regulatory powers, making proactive compliance a necessity rather than a luxury for companies planning long-term presence in the Saudi market.

What do these terms mean?

PDPL (Personal Data Protection Law): The Saudi legislative framework issued in 2021 to regulate the collection, storage, processing, and transfer of personal data, considered one of the most comprehensive regulatory frameworks for data protection in the Middle East.

Cross-border data transfer: Sending personal data belonging to Saudi citizens or residents in the Kingdom to parties or servers outside its geographical borders, which is restricted by legal safeguards.

Contractual safeguards: Binding clauses included in contracts with foreign recipient parties of data that obligate them to handle it in accordance with the standards stipulated in the Saudi law.
