European AI Act Comes into Force with Fines Up to 7% of Revenue

The European AI Act entered full implementation on August 2, 2026, as the European Commission's AI Office now possesses binding powers to impose fines on companies non-compliant with its requirements, marking a fundamental shift from the planning phase to actual enforcement.

The maximum fine reaches 35 million euros or 7% of the company's global revenue, whichever is higher, affecting companies operating in the European market even if based outside the Union, meaning American startups selling in Europe now face a real legal obligation rather than just a theoretical risk.

The law establishes a de facto global standard, as analysts believe companies building their systems according to its requirements will be able to operate in all markets, whereas those developing solely for the US market may face exorbitant redesign costs when a US federal regulatory law is issued in the future.

The United States remains in a state of legislative stalemate at the federal level regarding AI regulation, while markets expect the first European enforcement actions to emerge in the fourth quarter of 2026, setting a tone that will shape the compliance path for the entire AI industry globally.

What Do These Terms Mean?

European AI Act: The world's first comprehensive legislation to regulate artificial intelligence, classifying applications according to their risk level and imposing transparency and accountability requirements on companies before launching their products in the European market.

Compliance: Adherence to the requirements of laws and regulations. Non-compliance with this law means exposure to massive fines and the risk of being banned from the vast European market, which includes more than 450 million consumers.

Binding Powers: The legal authority to take real enforcement actions such as imposing fines and issuing stop orders, which distinguishes the actual implementation phase from non-binding guidance directives.
