The United States is witnessing a broad legislative wave aimed at reducing the scope of non-compete agreements, led by moves to protect healthcare sector workers and employees dismissed without just cause, marking a qualitative shift in the balance of power between employers and workers.

Several states and counties are requiring employers to waive non-compete stipulations for specific categories, such as doctors, nurses, and home care workers, as well as any employee terminated without proven objective reasons, allowing them to immediately move to competing employers without facing legal action.

These moves come in the wake of the 2024 decision issued by the Federal Trade Commission (FTC) regarding a nationwide ban on non-compete agreements. Although that decision remains pending before the courts, it has prompted numerous states to push forward with their local legislation.

Labor law experts observe a dual impact: on one hand, workers' bargaining power and job mobility are enhanced, and on the other hand, anxiety is rising among companies fearful of losing their trade secrets and proprietary knowledge through departing employees moving to competitors.

What do these terms mean?

Non-Compete Agreements: Clauses in employment contracts that prevent an employee from joining competing companies or establishing a similar business within a specified time period after leaving work, often restricting job mobility.

Dismissed Without Cause: Termination of an employment contract without the employee committing any infraction or negligence warranting dismissal, such as downsizing or restructuring.

Federal Trade Commission (FTC): The U.S. regulatory agency responsible for preventing monopolies and protecting fair commercial competition.
